These Terms of Service ("Terms") govern your use of NotionSync ("Service," "we," "our," or "us"), a form builder platform that integrates with Notion databases.

1. Acceptance of Terms

By creating an account, accessing, or using NotionSync, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not use our Service.

2. Description of Service

NotionSync provides:

• Form Builder: Create custom forms with drag-and-drop interface
• Notion Integration: Connect forms to Notion databases via OAuth
• Data Sync: Automatically sync form submissions to your Notion workspace
• Analytics: Track form performance and submission data
• Email Notifications: Automated alerts for form submissions
• API Access: Programmatic access to forms and data (paid plans)

3. Account Registration and Security

3.1 Account Requirements

• You must provide accurate, current, and complete information
• You must be at least 16 years old to use our Service
• One person or entity may maintain only one free account
• You are responsible for maintaining account security

3.2 Account Responsibilities

• Keep your password secure and confidential
• Notify us immediately of unauthorized access
• You are liable for all activities under your account
• We may suspend accounts that violate these Terms

4. Subscription Plans and Billing

4.1 Plan Types

• Free: 3 forms, 100 submissions/month
• Starter ($19/month): 10 forms, 1,000 submissions/month
• Pro ($49/month): 50 forms, 10,000 submissions/month
• Business ($99/month): Unlimited forms and submissions, API access

4.2 Billing Terms

• Subscriptions are billed monthly in advance
• All fees are non-refundable except as required by law
• We may change pricing with 30 days' notice
• Failed payments may result in service suspension

4.3 Plan Changes

• Upgrades take effect immediately
• Downgrades take effect at the next billing cycle
• Usage exceeding plan limits may result in service restrictions

4.4 Free Trial

• New paid plans include a trial period as specified
• Trial cancellation prevents future charges
• Trial abuse may result in account termination

5. Acceptable Use Policy

5.1 Permitted Uses

You may use NotionSync to:

• Create forms for legitimate business purposes
• Collect data with proper consent and legal basis
• Integrate with your own Notion workspaces

5.2 Prohibited Uses

You may not use NotionSync to:

• Spam or abuse: Send unsolicited communications or create misleading forms
• Illegal activities: Collect data illegally or violate applicable laws
• Harmful content: Create forms containing malicious, offensive, or inappropriate content
• System abuse: Attempt to circumvent usage limits or compromise our infrastructure
• Unauthorized access: Access other users' accounts or data
• Reselling: Redistribute or resell our Service without permission

5.3 Data Collection Compliance

When using forms to collect personal data, you must:

• Comply with applicable privacy laws (GDPR, CCPA, etc.)
• Provide appropriate privacy notices to form users
• Obtain necessary consents for data collection
• Implement appropriate data security measures

6. Content and Data Ownership

6.1 Your Data

• You retain ownership of all data submitted through your forms
• You are the data controller for personal data collected via your forms
• We act as a data processor for form submission data
• You grant us necessary rights to process data as part of our Service

6.2 Our Content

• NotionSync retains all rights to our platform, software, and documentation
• You receive a limited, non-exclusive license to use our Service
• Our branding, trademarks, and proprietary elements remain our property

6.3 Data Retention and Export

• Form data is synced to your Notion workspace immediately
• We retain submission data for a maximum of 24 hours for processing
• You can export your form configurations at any time
• Upon account termination, data is deleted within 30 days

7. Notion Integration

7.1 OAuth Authorization

• You must authorize NotionSync to access your Notion workspace
• We only access databases and pages you explicitly connect to forms
• You can revoke access at any time through Notion or our platform

7.2 Integration Responsibilities

• You are responsible for managing Notion workspace permissions
• Ensure your Notion account remains active and accessible
• NotionSync performance depends on Notion API availability
• We are not liable for Notion service interruptions or changes

8. Service Availability and Support

8.1 Service Level

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• Emergency maintenance may occur without notice

8.2 Support

• Email support provided to all users at noreply@sales.notionsync.co
• Response times: 24 hours for paid plans, 48 hours for free accounts
• Priority support available for Business plan subscribers

9. API Terms (Business Plan)

9.1 API Access

• API access included with Business plan subscriptions
• Rate limits apply to prevent system abuse
• API keys must be kept secure and confidential

9.2 API Usage Rules

• Use API only for legitimate business purposes
• Do not exceed published rate limits
• Report security vulnerabilities responsibly
• API availability subject to these Terms

10. Intellectual Property

10.1 Our Rights

• NotionSync name, logo, and branding are our trademarks
• The platform software and technology are our proprietary property
• We reserve all rights not expressly granted to you

10.2 Infringement Claims

If you believe content on our platform infringes your rights:

• Include your contact information and description of infringement
• We will investigate and respond promptly

11. Privacy and Data Protection

11.1 Privacy Policy

• Our Privacy Policy governs how we handle your personal data
• By using our Service, you consent to data processing as described
• We implement appropriate security measures to protect your data

11.2 GDPR Compliance

• We comply with GDPR and other applicable privacy regulations
• You are responsible for GDPR compliance when collecting personal data via forms
• Data processing agreements available upon request for Business plan users

12. Disclaimers and Limitation of Liability

12.1 Service Disclaimers

• Our Service is provided "as is" and "as available"
• We do not warrant uninterrupted, error-free, or secure operation
• We disclaim all warranties, express or implied, to the fullest extent permitted by law

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTIONSYNC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12.3 Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your use of our Service
• Your violation of these Terms
• Your violation of applicable laws
• Content you submit through our platform

13. Termination

13.1 Termination by You

• Cancel your account at any time through your dashboard
• Paid subscriptions continue until the end of the billing period
• No refunds provided for partial billing periods

13.2 Termination by Us

We may terminate your account:

• For violation of these Terms
• For non-payment of fees
• For illegal activities
• At our discretion with reasonable notice

13.3 Effect of Termination

Upon termination:

• Access to your account and data will be suspended
• Form submissions will no longer be processed
• Data will be deleted within 30 days unless legally required to retain
• You may export your data before termination

14. Changes to Terms

14.1 Modifications

• We may modify these Terms at any time
• Material changes will be announced via email or platform notification
• Continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

14.2 Notification

We will provide at least 30 days' notice for material changes affecting:

• Pricing or billing terms
• Significant service modifications
• Data handling practices

15. General Provisions

15.1 Governing Law

These Terms are governed by the laws of New York, United States, without regard to conflict of law principles.

15.2 Dispute Resolution

• Disputes will be resolved through binding arbitration
• Arbitration conducted under American Arbitration Association rules
• Class action lawsuits are waived
• Injunctive relief may be sought in court when appropriate

15.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

15.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NotionSync.

15.5 Assignment

• You may not assign your rights under these Terms
• We may assign our rights and obligations to affiliates or acquirers
• Assignment does not affect your rights under these Terms
